Getting Started

Before placing your deed preparation order, it is important that you collect such documents and information as the following:


General Transfers

  • Prior Vesting Deed (ie. Current and Last Recorded Deeds).
  • Prior Title Abstract, Letter Report, Title Commitment or Title Insurance Policy.
  • Current Sale Contracts, Installment Contracts, Contract for Deed, Asset Purchase Agreements, Options and Lease Purchase Agreements.
  • Current Printout from the Assessor's Database and/or Collector of Revenue's Database.
  • Current or Prior Survey

Transfers of Vacation or Recreational Properties

  • Time Share Agreement or Co-Occupancy Agreement.
  • Maintenance Agreement.
  • Transfer Agreement and Instructions.
  • Rights of First Refusal and/or Option Agreements.

Transfers to or from Entities

  • If the transfer is to or from a Corporation, a copy of the Certificate of Incorporation, Certificate of Good Standing, Articles of Incorporation, Bylaws, and Resolution approving the Sales Transaction.
  • If the transfer is to or from a Limited Liability Company, a copy of the Certificate of Organization, Articles of Organization, Operating Agreement, and Resolution approving the Sales Transaction.
  • If the transfer is to or from a Partnership, a copy of the Partnership Agreement and Consent approving the Sales Transaction.
  • If the transfer is to or from an Association, a copy of the Association's Charter, Bylaws and Standing Rules.
  • If the transfer is to or from a Trust, a copy of the Trust Instrument and the Certificate of Trust.

Transfers Associated with Marriage and Divorce

  • If the transfer is to add your spouse, a copy of the Marriage Certificate.
  • If the transfer relates to separate property, a copy of Prenuptial Agreement, Postnuptial Agreement, or Waiver of Marital Rights.
  • If the transfer is to remove your former spouse, a copy of the Divorce Decree and Separation Agreement.

Transfers Associated with Estate Planning and Death

  • It the transfer is to or from a Trust, a copy of the Trust Agreement and Trust Certificate.
  • If the transfer is related to the owner's death, a copy of the Death Certificate and a copy of the Affidavit of Death or Affidavit of Joint Tenancy.
  • If the property is included in a Probate Estate, a copy of the Letters of Testamentary Administration or other Order of the Probate Court approving the Sales Transaction.

Transfers Associated with Foreclosure and Bankruptcy

  • If the transfer is to a creditor, a copy of Deed of Trust, Promissory Note and Notice of Foreclosure Sale.
  • It the transfer is included in a Bankruptcy Estate, a copy of the Order from the Bankruptcy Court approving the Sales Transaction.

Transfers to Consolidate or Divide Parcels of Land

  • Copy of the Assessor's Plat and Database Printout.
  • Current Survey.

Transfers to Correct Errors, Resolve Disputes or Address Changed Circumstances

  • Copy of the Assessor's Plat and Database Printout.
  • Copy of the Subdivision Plat.
  • Copy of the Current Survey or Boundary Adjustment Plat.
  • Copy of the Original Deed containing the Scrivenor's Error.
  • Copy of the Original Deed Establishing the Type of Vesting.

Restricted Transfers

  • For transfers to create or terminate a life estate, conditions, covenants and restrictions, easement, facade restrictions or conservation easement and restrictions, please contact our office for instructions at 314-971-4381.
