Common Deed Transfers

We have experience handling a wide variety of deed transfers.  Here are some of the more common types of deed transfers:

General Transfers

  • Transfers incident to sale of real estate (including For Sale By Owner transactions).

Transfers of Vacation or Recreational Properties

Transfers of Investment Properties

Transfers Associated with Marriage and Divorce

Transfers Associated with Estate Planning and Death

  • Transfers for estate planning purposes.
  • Gift transfers between family members or related parties.
  • Transfers to and from trusts for estate planning purposes.
  • Transfers upon death of joint tenant.
  • Transfers due to disposition under wills or trusts or by order of the probate court.

Transfers Associated with Foreclosure and Bankruptcy

  • Transfers to creditors such as deeds in lieu of foreclosure.
  • Transfers by order of bankruptcy court.

Transfers to Consolidate or Divide Parcels of Land

  • Transfers to consolidate multiple, contiguous parcels into a single parcel with a single tax parcel number.
  • Transfers to convey part (but not all) of a property.

Transfers to Correct Errors, Resolve Disputes or Address Changed Circumstances

  • Transfers to adjust boundary of lot due to encroachments, adverse possession or other disputes.
  • Deeds to correct scrivenor's errors in original deed.
  • Deeds to change vesting (e.g. from joint tenants to tenants to tenants in common).

Restricted Transfers

  • Transfers to create or terminate life estate.

  • Transfers with forfeiture and other right to re-entry provisions.
